Pebble Delta LLC Terms & Conditions

PLEASE READ THESE TERMS & CONDITIONS (“Terms”) CAREFULLY.

 

By accessing or using the Pebble Delta LLC (“Pebble Delta,” “we,” “us,” or “our”) stock market forecast service and any related websites, dashboards, emails, PDFs, or other content (collectively, the “Service”), you (“you” or the “Subscriber”) agree to be bound by these Terms and by our [Privacy Policy]. If you do not accept all of these Terms, do not use the Service.

1. Subscription License & Personal-Use Limitation

1.1 Limited License. Upon payment of applicable fees, Pebble Delta grants you a revocable, non-exclusive, non-transferable license to access and view subscription content for your own personal, non-commercial use only.

 

1.2 No Redistribution. You may download or print a single copy of materials solely for personal reference and must retain all copyright notices. You may not reproduce, share, sell, upload, email, post, publish, broadcast, or otherwise distribute any portion of the content without our prior written consent.

1.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Sharing passwords or simultaneous log-ins by multiple users is prohibited.

 

2. Prohibited Conduct

You agree not to:

 

  • Employ bots, spiders, scrapers, or other automated means to access, copy, or monitor any part of the Service;

 

  • Circumvent, disable, or interfere with security-related features;

 

  • Introduce viruses, malware, or other harmful code, or impose an unreasonable load on our servers;

 

  • Reverse-engineer, decompile, or create derivative works from the Service;

 

  • Use the Service for any unlawful purpose or in violation of these Terms.

 

3. No Investment Advice; No Fiduciary Duty

 

3.1 Informational Content Only. All forecasts, commentary, and data are general, educational information. Pebble Delta is not a registered investment adviser, broker-dealer, or tax professional. Nothing in the Service constitutes, or should be relied upon as, personalized financial, legal, or tax advice.

 

3.2 Your Responsibility. You alone decide whether, when, and how to act on any information provided. Consult a qualified professional for advice tailored to your situation. Pebble Delta disclaims all liability for any investment losses or other damages arising from your use of the Service.

 

4. Data Accuracy, Timeliness & “As-Is” Warranty Disclaimer

 

While we use sources believed reliable, all content is provided “AS IS” and “AS AVAILABLE,” without warranty of any kind—express or implied—including accuracy, completeness, timeliness, or fitness for a particular purpose. We may correct errors, update data, or withdraw content at any time without notice.

 

5. Performance Disclaimer

 

PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS. Investing involves risk, including possible loss of principal. No forecast or strategy can guarantee profits or avoid losses, and any stated targets are aspirational only.

 

6. Subscription Billing, Auto-Renewal & Cancellation

 

6.1 Billing. Subscriptions are billed in advance (monthly or annually, as selected) and set to auto-renew until canceled.

 

6.2 Trial Offers. If a trial period is offered, your payment method will be charged at the standard rate when the trial ends unless you cancel before that date.

 

6.3 How to Cancel. Log in to your account settings or contact us through our contact page (see bottom of this document) at least 24 hours before your next renewal. Cancellation is effective at the end of your current term.

 

7. Modification, Suspension & Termination

 

We reserve the right to modify, suspend, or discontinue any feature or part of the Service at any time. We may terminate or suspend your access immediately if we believe you have violated these Terms or applicable law. If we permanently discontinue the Service, you will receive a prorated refund for any prepaid, unused portion.

 

8. Intellectual-Property Rights

 

All logos, trademarks, text, graphics, charts, and other materials are the property of Pebble Delta or its licensors and are protected by U.S. and international intellectual-property laws. Except for the limited license in § 1, no rights are granted to you.

 

9. Privacy

 

Your use of the Service is also governed by our [Privacy Policy], which explains what data we collect, how we use it, your rights, and how we safeguard information in compliance with CCPA, GDPR, and other laws.

 

10. Limitation of Liability

 

To the fullest extent permitted by law, Pebble Delta and its owners, employees, and agents shall not be liable for any indirect, consequential, incidental, punitive, or special damages (including lost profits) arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability shall not exceed the greater of (a) the amounts you paid within the preceding twelve months or (b) $100.

 

11. Indemnification

 

You agree to indemnify and hold Pebble Delta harmless from any claims, losses, or expenses (including attorneys’ fees) arising from your violation of these Terms, illegal conduct, or misuse of the Service.

 

12. Dispute Resolution & Arbitration Agreement

 

12.1 Binding Arbitration. Any dispute or claim relating in any way to these Terms or the Service shall be resolved exclusively by final, binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules.

12.2 No Class Actions. You and Pebble Delta agree to bring claims only on an individual basis; class or representative actions are not permitted.

12.3 Opt-Out. You may opt out of this arbitration agreement by sending written notice through our contact page (see bottom of this document) within 30 days of your first subscription purchase; otherwise, you are bound by it.

12.4 Governing Law & Venue. These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. If a claim proceeds in court (e.g., small-claims exceptions or opt-out), it must be brought exclusively in the state or federal courts located in Raleigh, North Carolina.

 

13. Eligibility

 

You represent that you are at least 18 years old and legally capable of entering into a binding contract. If you are using the Service on behalf of an entity, you confirm that you have authority to bind that entity to these Terms.

 

14. Miscellaneous

 

  • Severability. If any provision is held invalid, the remainder remains in effect.
     

  • Entire Agreement. These Terms, plus the Privacy Policy and any order-form or offer-specific terms, constitute the entire agreement between you and Pebble Delta.
     

  • Changes to Terms. We may update these Terms by posting a revised version and updating the “Effective Date.” Continued use of the Service after changes means you accept the new Terms.
